1. About these terms

These terms govern your use of the website at ojajasmart-mobility.com, operated by OJAJA Smart Mobility Ltd, a company registered in Nigeria with its operating base at Ojaja Mall, Ajah, Lagos State. By using this website you accept these terms.

2. Current status of the service

OJAJA is in pilot preparation. The website describes a service we intend to operate. Vehicle images on the site are visual representations of the intended fleet livery, and figures shown within illustrative app screens are indicative only and do not constitute pricing.

Nothing on this website is an offer to provide transport services, and no contract for transport is formed by using it.

3. The waiting list

When you submit the waiting list form:

• you confirm the information you provide is accurate and that you are at least 18 years old;
• you consent to us contacting you about the launch of the service;
• you understand that being on the list does not reserve a vehicle, guarantee access, or guarantee acceptance as a driver;
• you may ask to be removed at any time by emailing us.

Any promotional offer mentioned on the site, including a first ride at no cost, is subject to availability, to the terms published at the time the service launches, and may be withdrawn or varied before launch.

4. Drivers

Expressing interest in driving with OJAJA does not create an employment relationship, a contract, or any obligation on either side. Driver onboarding, when it opens, will be subject to separate written terms and to verification of licensing, including a valid Nigerian driver's licence and LASDRI certification where required.

5. Acceptable use

You agree not to:

• submit false information, or another person's details without their permission;
• use automated means to submit the form or to harvest data from the site;
• attempt to gain unauthorised access to any part of the site or its underlying systems;
• copy, reproduce or republish substantial parts of the site for commercial purposes.

6. Intellectual property

The OJAJA name, the OJAJA and OJAJARide marks, the site design, text, illustrations and other material are owned by or licensed to OJAJA Smart Mobility Ltd. You may not use them without our written permission. Third party marks appearing on the site remain the property of their owners.

7. Links and third parties

The site may link to third party services, including social media and payment providers. We are not responsible for their content or their handling of your data, which is governed by their own terms.

8. Availability

We aim to keep the website available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it without notice.

9. Liability

The website is provided on an "as is" basis. To the fullest extent permitted by Nigerian law, we are not liable for indirect or consequential loss arising from your use of this website. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

Separate terms will govern the transport service itself once it launches, and those terms will address matters such as trips, fares, safety and insurance.

10. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the exclusive jurisdiction of the courts of Lagos State.

11. Changes

We may update these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
